GREEN BAY, WI (WTAQ) - Former Calumet County District Attorney and Ken Kratz is seeking a dismissal of civil lawsuit against him seeking monetary damages.

Kratz resigned late last year after the public became aware that he had sent 30 sexually suggestive texts messages to a domestic abuse victim trying to initiate an affair.

At the time, Kratz was prosecuting the abuse victims ex-boyfriend.

Kratz filed a response this week in Green Bay district court to the lawsuit brought by Stephanie Van Groll in mid-October.

The response admits that while the text messages were revolting, "they do not rise to a level that constitutes sexual harassment under the Equal Protection Clause of the 14th Amendment".

Kratz was cleared of criminal wrongdoing back last year. The unique situation has lawmakers working on legislation to better protect sexual victims.
